*For the purpose of this Warranty Statement, the Chinese version shall be deemed as the original and controlling text. Any disputes arising from the interpretation of the translated version shall be resolved by reference to the Chinese text.
Thank you for purchasing YMTC ZHITAI® retail products (hereinafter referred to as "Products"). YMTC appreciates your trust and is continuously committed to providing you with superior service.
Please read the following terms and conditions before using the Products. By using this Product, you acknowledge and agree to the terms and conditions of the YMTC ZHITAI® Retail Product Limited Warranty Statement (hereinafter referred to as the "Agreement").
This warranty covers only ZHITAI® retail products.
YMTC reserves the right to update this Agreement at its discretion. Updated terms will be announced through official channels such as the official website. Continued use of the Products constitute your acceptance of the updated terms.
YMTC warrants to the original purchaser (hereinafter referred to as "You") that, subject to the terms and conditions set forth herein, the Products shall be free from defects in materials and workmanship for the limited warranty period, calculated as follows:
1) Internal Solid State Drives (SSDs) (whichever occurs first based on the following criteria):
A. The limited warranty period for internal SSDs begins on the date You purchase the product in its original sealed packaging and ends on the corresponding limited warranty expiration date (refer to Section VIII "Warranty Period and TBW List" of this Agreement). If valid proof of original purchase cannot be provided, the warranty start date will be determined based on the product's manufacturing date.
B. The warranty ends when the Total Bytes Written (TBW) of the internal SSDs exceeds its threshold (refer to TBW thresholds in Section VIII "Warranty Period and TBW List" of this Agreement). The TBW value of the Product shall be determined by the management software released by YMTC (https://www.ymtc.com/cn/techsupport.html) or the TBW value measured by the third-party professional tool CrystalDiskInfo version 8.0 or above.
2) Portable Solid State Drive (PSSD) (whichever occurs first based on the following criteria):
A. The limited warranty period for PSSD begins on the date You purchase the product in its original sealed packaging and ends on the corresponding limited warranty expiration date (refer to Section VIII "Warranty Period and TBW List" of this Agreement). If valid proof of original purchase cannot be provided, the warranty start date will be determined based on the product's manufacturing date.
B. The warranty ends when the Total Bytes Written (TBW) of the PSSD exceeds its threshold (refer to TBW thresholds in Section VIII "Warranty Period and TBW List" of this Agreement). The TBW value of the Product shall be determined by the management software released by YMTC (https://www.ymtc.com/cn/techsupport.html) or the TBW value measured by the third-party professional tool CrystalDiskInfo version 8.0 or above.
3) Micro SD Card:
The limited warranty period for Micro SD Card begins on the date You purchase the product in its original sealed packaging and ends on the corresponding limited warranty expiration date (refer to Section VIII "Warranty Period and TBW List" of this Agreement). If valid proof of original purchase cannot be provided, the warranty start date will be determined based on the product's manufacturing date.
The limited warranty in this Agreement does not apply to the following circumstances:
1)Use of the Product outside its intended function and environment for retail consumer products (e.g., use of retail products in enterprise environments such as servers or industrial PCs);
2)Malfunctions or defects resulting from failure to operate, use, maintain, or store the Product in accordance with any accompanying instructions;
3)Damage caused by intentional acts, negligence, misuse, improper installation, or force majeure, including but not limited to: improper insertion/removal of external devices, liquid contact, fire, abnormal voltage, drops, impacts, crushing, vibration, and other mechanical damage;
4)Any unauthorized disassembly, repair, modification, or tampering;
5)Any unauthorized opening of the housing/enclosure of a PSSD;
6)Any malfunction or defect caused by third-party products, software, or components (whether authorized or not);
7)Any loss, damage, deformation, alteration, or other physical damage to returned products resulting from improper packaging or transportation;
8)Any product from which the original label (such as serial number sticker, tamper-evident seal, etc.) has been removed, destroyed, covered, tampered with, or where the product itself has been covered or altered;
9)Any product with deformation, alteration, or other physical damage resulting from misuse, including but not limited to deep scratches;
10)Any product that violates national, provincial, state, or local laws or other applicable export regulations;
11)This product is not designed for, and shall not be used in (including but not limited to) life support systems, critical care, medical or safety equipment, or any other application where failure could lead to risk of life, personal injury, or bodily harm, or any military or defense application, or any other application subject to specific terms or regulations; malfunctions or defects arising from unauthorized use in the above scenarios;
12)The lifetime warranty for ZHITAI PRO Micro SD Card with Adapter does not apply to using the product, either alone or in combination, as a continuous recording tool or in any write-intensive device, including but not limited to dash cams, security cameras, surveillance systems, dashboard monitors, flight recorders, IP/network cameras, continuous recording set-top box devices, continuous data logging devices like servers, dedicated benchmarking equipment, and as the primary drive in specific devices; malfunctions or defects arising from unauthorized use in the above scenarios.
YMTC shall not be responsible for any losses resulting from or related to Your use of the Products in the aforementioned manner, and You shall bear all associated risks.
Data recovery is not covered under YMTC's warranty. YMTC is not responsible for any costs or expenses related thereto, or for any data loss or damage under any circumstances.
YMTC's warranty does not cover any costs or fees associated with overhaul/assembly and data recovery related to product repair or replacement, including but not limited to labor, installation, or other charges.
In no event shall YMTC's total liability exceed the price You paid for the Products.
Accessories such as data cables (if included) are consumables and are not covered by the warranty.
Subject to the conditions and terms of this Agreement, if the Product is defective and does not conform to the published specifications under normal use, and You own the Product and it is within the warranty period, YMTC will, depending on the circumstances, take one of the following measures:
1)Repair Your Product (Micro SD Card products will be replaced, not repaired);
2)Replace it with a product of the same model and specifications; if the same model is unavailable due to discontinuation, YMTC will replace it with another ZHITAI® product of equal or superior performance. The replacement product may be a refurbished unit that has been tested and meets YMTC specifications;
3)If Your Product is diagnosed as No Trouble Found (NTF) or does not meet the terms and conditions for warranty service under this Agreement, Your Product will be returned to You. YMTC will ship the repaired or replacement product to You within a reasonable period after receiving Your returned product, and You will not bear the associated shipping costs (Mainland China only). In case of replacement, the original product will not be returned to You.
For products that are repaired or replaced under warranty, YMTC provides warranty service for the longer of the following two periods: the remaining days of the original warranty period or ninety (90) days from the date the serviced product is shipped to You.
The above warranty commitment from YMTC is provided solely to the original purchaser and is non-transferable.
1. Individual Consumers in Mainland China:
You may contact the authorized distributor or retailer from whom You purchased the ZHITAI® product, or You may call the YMTC ZHITAI® Customer Service Center during business hours. You will need to provide:
1)Your contact information and name;
2)Proof of original purchase (indicating the original purchase date, purchase channel, product description, and price);
3)Product model name, product identification number, and photos of the exterior;
4)Description of the product issue, and the usage platform (e.g., used in a desktop, laptop, PS5, etc.);
5)Additional information as necessary.
If YMTC determines the product may be faulty, You will receive a Return Merchandise Authorization (RMA) number and instructions for return. Please follow the return instructions to ship the product requiring warranty service to us. The product and all accessories (screws are not required) must be returned to obtain warranty service. Products returned without prior authorization (i.e., without an RMA number) will be returned to You, and the shipping costs incurred will be Your responsibility. Please carefully read and confirm all terms of the return policy before returning the product.
Please note that counterfeit products, including but not limited to products infringing YMTC's trademarks or patents, are not covered by YMTC's warranty.
Additionally, please note that when submitting warranty claims through the ZHITAI® Customer Service Center, the maximum number of defective units per claim shall not exceed five. In the event of frequent claims, we reserve the right to request further verification of the valid proof of original purchase. To avoid any inconvenience, you are advised to contact the original dealer or distributor from whom the product was purchased prior to contacting us.
2. Individual Consumers Outside Mainland China:
You may contact the place of purchase or the authorized distributor or retailer from whom You purchased the ZHITAI® product. If the original point of purchase cannot provide after-sales service, and You cannot obtain the contact information of an authorized distributor or retailer, You may email the ZHITAI® Customer Service Center at ZHITAI_Support@ymtc.com to obtain contact information.
The documentation required and the processing process for obtaining warranty service are subject to the requirements of the actual service provider.
You should regularly back up the information contained on the Product to protect Your information and prevent potential data loss risks. YMTC shall not be liable for any data loss, deletion, corruption, or alteration that may result from a potential product failure.
Before shipping a product requiring warranty service, You should promptly back up Your data and erase all confidential, proprietary, or personal information You wish to protect.
YMTC is not responsible for the loss of any software programs, data, or other information contained on a product submitted for repair.
This Agreement sets forth the entire liability of YMTC. To the extent permitted by applicable law, except for the express warranties stated herein, YMTC disclaims all other express and implied warranties, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, non-infringement, course of dealing, or trade usage. All express and implied warranties are limited to the duration of the limited warranty.
In no event shall YMTC, its suppliers, or any affiliates be liable for any indirect, incidental, special, or consequential damages, any financial loss, or any loss of files or data, even if YMTC has been advised of the possibility of such damages.
YMTC's liability shall in no case exceed the price You paid for the Product. These limitations and exclusions apply to the maximum extent permitted by applicable law.
Some regions or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to You.
